These terms apply when you use karatandkin.com or buy from it. "We", "us" and "Karat & Kin" mean Karat & Kin LLC, a New York limited liability company. By using the site or placing an order you agree to these terms and to our Privacy policy. Please read them. If you don't agree, please don't use the site.
Who can buy
You must be at least 18, or buying with the involvement of a parent or guardian. We ship only to addresses in the United States.
Product information
We work to describe every piece accurately: its metal, stones, measurements and weight are listed on its page. Some of our photographs are created or enhanced with digital and AI tools to show a piece as worn or in a setting. They are close representations, not exact records of the item you'll receive. Colors vary between screens, and handmade and natural materials vary a little from piece to piece. If what arrives isn't what the listing describes, our Shipping & returns policy covers you.
Prices and availability
Prices are in US dollars. Many pieces are held in stock by our suppliers, and the availability shown on the site is updated regularly but can change quickly. A piece can occasionally sell out between your order and our confirming it with the supplier. If that happens, or if a piece was listed at an obviously wrong price, we'll tell you and cancel that item with a full refund of what you paid for it. We never charge you a different price than the one you agreed to at checkout.
Orders and payment
Placing an order is an offer to buy. Your order confirmation email confirms we received it; the sale is complete when the piece ships. We may decline or cancel an order, with a full refund, if we suspect fraud, can't verify a payment, or can't fulfil it.
Payment is taken on Stripe's secure checkout page when you place your order. Sales tax is calculated by Stripe from your shipping address and shown before you pay. Shipping costs and delivery estimates are also shown at checkout before you pay.
Discount codes apply only as stated, can't be exchanged for cash, and may end at any time without affecting orders already placed.
Shipping, returns and exchanges
Delivery, return and exchange terms are set out in our Shipping & returns policy, which forms part of these terms. Risk of loss passes to you when the carrier delivers your order.
Using the site
You may browse and shop for your own personal, non-commercial use. You agree not to:
- copy, scrape or harvest the site's products, prices, text or images by automated means, or republish them, without our written permission;
- interfere with the site's security or operation, or try to reach parts of it not meant for the public;
- place orders you don't intend to pay for, or use another person's payment details;
- use the site for anything unlawful or fraudulent.
We may block access to anyone who breaks these rules.
Our content
The site's text, photographs, graphics, design and the Karat & Kin name and logo belong to us or the companies that license them to us. Nothing in these terms gives you the right to use them beyond viewing and sharing links to the site. Some product imagery is supplied by, and remains the property of, the companies that make the pieces.
Links to other sites
The site links to other services, such as our social media pages and Stripe's checkout. We're not responsible for their content or how they handle your information; their own terms and policies apply.
Disclaimers
We work to keep the site accurate and available, but we provide it "as is" and can't promise it will always be uninterrupted or free of errors. To the fullest extent the law allows, we disclaim all warranties not stated in these terms, except any warranty that by law can't be excluded. Nothing in these terms limits rights you have under consumer protection law.
Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special or consequential losses arising from your use of the site or your purchases, and our total liability for any claim about an order is limited to the amount you paid for that order. Some states don't allow these limits, so they may not apply to you.
Disputes
If something goes wrong, please contact us first. Most problems are solved quickly that way. These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute that we can't resolve together will be decided by the state or federal courts located in Nassau County, New York, and you and we agree to their jurisdiction. Either of us may instead bring an individual claim in small claims court where the claim qualifies.
Changes to these terms
We may update these terms from time to time. The version in effect when you place an order applies to that order. The date at the top shows when they last changed.
